68-year-old former Indian Space Research Organisation employee sustained a bullet injury to his throat after a licensed pistol reportedly misfired at the hands of a four-year-old boy in Peenya police station limits on Monday morning. The incident occurred at the residence of KM Muniaraju, a former corporator from Dasarahalli and a realtor when his grandson was playing with his licensed firearm. The victim identified as Govindappa, a resident of Chokkasandra was visiting Muniraju and is undergoing treatment at a private hospital in the city.

According to police Govindappa, along with S Muniraju and Raju returned to Muniraju's residence from a function. Muniraju removed his pistol from its holster and kept it on a swing when he went to wash his face and his grandson reportedly spotted the unattended pistol and started playing with it.

According to the police all three of them saw the child near the firearm but neither cautioned nor removed the pistol from him. They were seated next to the boy on the second floor of the building chatting and reading newspapers when the firearm misfired and the bullet pierced Govindappa's throat. However, according to Raju, an eyewitness to the incident, the firearm was kept on a swing and misfired when it fell down after the child pushed the swing. "We immediately rushed him to Sparsh Hospital as he was bleeding profusely," said Raju.

DCP (North) TR Suresh said that the entire incident has been captured on CCTV installed in the house. The police also said that the safety catch of the firearm was not on and there was a bullet in its chamber when it accidentally went off when the child was playing with it. Meanwhile, hospital authorities said that Govindap-pa was kept under observation and will undergo a surgery.

"The bullet entered from the right side and there is an exit wound on the left side. He has not suffered any major internal organ injury," said Chinnadurai R, critical care specialist, Sparsh Hospital where Govindappa is undergoing treatment

Peenya police have registered a case against KM Muniraju under the Arms Act of Section 338 of IPC.

Except that the pistol did not "misfire". It fired, pure and simple. If it had misfired, no one but have been hurt.

Very true. All the news $hit is make up and fabricated. Mis-fired, Kid was playing with gun, Corporator Licensed weapon etc gives the whole picture.

Something like this has happened in Hyderabad, when actor Balakrisha shot producer Bellamkonda with his licensed handgun. Know one know the update on this event and closed.

Let us not give these type of motivated news items any more importance than they deserve. There are tonnes of more news items that clearly tell criminals are having a field day because they find unarmed victims as their targets. Thousands of rapes, murders, dacoities and kidnappings are happening. No one is telling that these victims were unable to exercise their inalienable right of self defense because they have been effectively disarmed due to Arms Act 1959.

I have already posted in another post that in Vidhya Singh v. State of Madhya Pradesh (1971) 3 SCC 244, Supreme Court observed "the right of self-defence is a very valuable right, serving a social purpose and should not be construed narrowly." and the same also repeatedly emphasized and reiterated in at least eighteen more Supreme Court judgments. Why the media is not highlighting this aspect? Has the media been subverted by vested interests? The mentioned post can be read here viewtopic.php?f=4&t=24511&p=243291#p243291 I would request the readers of this post if they have any friends or relatives in the media, this Supreme Court judgement should also be highlighted along with or within the news items of rapes, murder, dacoities, kidnapping etc. which are being published on almost daily basis. They would be doing a great moral and social responsibility by highlighting in the media and internet, this Supreme Court judgment and the real harm Arms Act 1959 is doing to the society.
