New Arms Regulations regarding .22 Air Rifles

Post by thind_aman » Sun Dec 04, 2016 5:23 pm

Greetings Everyone!

Is there any clarity about the legal status of .22 Air Rifles in India as of now? Does one require an arms license to own one? If yes, what are people doing with their existing .22 air rifles?

I have two .22 IHP guns, I'm not sure what to do with these if they are not legal anymore.

Any help/suggestions would be highly appreciated.

Thanks and Regards,
Aman Thind

The new Arms Rules have been enacted under Section 44 of Arms Act 1959. And as per Section 44(3) of Arms Act 1959, these Rules need to be approved by both houses of Parliament within 30 days of their session. Now the question is -

1. have these Rules been presented within 30 days of session of both houses of Parliament?

2. if yes, then what did the both houses of Parliament do? Reject or amend or approve these Rules?

Thank you @SMJ and @goodboy_mentor. Is it a good idea to submit an RTI to know the status?

If these rules are passed and .22 air rifles are actually made illegal, do you think it's possible to implement this? How do you envision these rules being put into action? Will one need to surrender their air rifles? Even thinking about it feels absurd. Your thoughts?

Doing RTI is one of the ways. The status can also be checked by visiting the Lok Sabha and Rajya Sabha websites.

The corrupt and oppressive police will have a mighty good time to extract hefty bribes or file cases under Arms Act 1959 for possessing air guns without license. The proper legal way is to apply for arms license for air guns or deposit them.

Of course .177 calibers below 15 joules (as most Indian AR's are) are exempt

15 joules or 15 fpe? Even 12 fpe is 16 joules. As far as I can remember, it was 20 joules in the arms act.

Most Indian airguns are NOT in .177 calibre, in fact barely 5% would be in that calibre. These rules in effect will make criminals out of several crore law abiding citizens and most of them would be minors!

Let me re phrase my earlier statement written in a huge hurry "of course .177 calibre below 15 fpe (all Indian made .177 calibre are normally well below the limit) will be exempt" [emoji14]
Don't know about the percentage of AG's in .177 but completely agree that quite a few people may end up paying a very high price because of this silly regressive and impractical new law.

what is the latest status of the law ? i could not find the law in lok sabha website and i could not find it in the wikipedia list of laws passed by the Indian parliament. and having read the notification, it does not mention what happens to .22 air rifles in possession or how they are to be deposited. what do people do when the police comes in to arrest them for possessing "illegal" .22 air rifles ? this is what bothers me as i am 18 and any trouble with police stands the chance to completely ruin my future.

I too bought my two .22 airguns from Aimco Enterprise and they said that they will neither replace nor convert them to. 177 but will sell .22 ammo as long as their stock lasts. After their stock ended they said to dump the gun and buy a new one in .177.
I decided if I have to buy a new one better to do it sooner than later. Bought .177 and kept .22 in my cabinet , shooting it occasionally. Recently found a buyer for the precihole. 22 and sold it to him, the other .22 kept some of its parts and sold the rest as scrap metal along with my old books.

Can u share how you disassembled your other air-rifle.. have u used in spring compression? I am thinking on cleaning mine but I have no spring compressor, but i have watched a video on you-tube where a guy is doing without spring compressor without any problem.
Kindly guide me what procedure have u used.
